Exceptions to Confidentiality

While we make every effort to maintain the confidentiality of your information, there are certain circumstances under which we are legally required to disclose information without your consent:

  • Mandatory Reporting of Child Abuse or Neglect: Massachusetts law requires mental health professionals to report any suspected child abuse or neglect to the Department of Children and Families (DCF).
  • Mandatory Reporting of Elder Abuse: We are required to report any suspected abuse, neglect, or exploitation of elderly or disabled persons to the appropriate authorities.
  • Imminent Harm to Self or Others: If we believe you pose an imminent danger to yourself or another person, we are ethically and legally obligated to take steps to protect you or the potential victim, which may include disclosure of information to appropriate parties.
  • Court Orders and Legal Proceedings: We may be required to disclose information in response to a valid court order or subpoena.

Your Rights Under HIPAA

Under HIPAA, you have the right to:

  • Request access to your protected health information
  • Request amendments to your health records
  • Receive an accounting of disclosures of your health information
  • Request restrictions on certain uses and disclosures of your information
  • Request confidential communications (e.g., receiving communications at a specific address or phone number)
  • File a complaint if you believe your privacy rights have been violated

DLH Consulting & Psychiatric Services maintains administrative, technical, and physical safeguards to protect the confidentiality, integrity, and availability of your protected health information. All staff members receive regular training on HIPAA compliance and privacy practices.

We use secure, HIPAA-compliant electronic health record systems and telehealth platforms to ensure your information is protected during storage and transmission.
